WhatsApp Meta Platforms Data Sharing Policy: National Company Law Appellate Tribunal (NCLAT) has given an important decision in favor of WhatsApp. According to PTI, the tribunal has temporarily lifted the ban imposed on WhatsApp on sharing data with meta platforms. This decision will have a direct impact on the 58 crore users of WhatsApp in the country. It is noteworthy that in 2021, WhatsApp had tried to implement the policy of data sharing with its parent company Meta and other platforms in India, which was temporarily stopped by NCLAT after the intervention of the Competition Commission of India (CCI).

The National Company Law Appellate Tribunal (NCLAT) on Thursday stayed the five-year ban on data sharing imposed by the Competition Commission of India (CCI) on WhatsApp and Meta.

This restriction was imposed in case of sharing data for advertising purposes. Meta welcomed NCLAT’s decision and said it will consider further action and aims to support the millions of businesses that depend on their platform for growth and innovation. Earlier, CCI had imposed a fine of Rs 213.14 crore on Meta regarding the privacy policy update of WhatsApp in November 2024.

Meta and WhatsApp had challenged this order before NCLAT, which is the appellate authority on CCI orders. Under CCI’s order dated November 18, 2024, Meta and WhatsApp were directed to implement certain measures within the stipulated time frame to address anti-competitive issues.
